Privacy Policy

Last updated: 1 January 2026

1. Introduction

Top of the Class ("we", "us", "our") is committed to protecting the privacy of individuals who use our website and services. This Privacy Policy explains how we collect, use, disclose, and safeguard your personal information in accordance with the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

2. Information We Collect

We collect personal information that you provide directly to us, including:

  • Contact details (name, email address, phone number, suburb)
  • Student information provided by parents or guardians through our enquiry form — including the child's year level, subject, suburb, and any names provided
  • Tutor information (qualifications, experience, subjects taught, Working With Children Check details)
  • Payment and billing information (processed securely via third-party payment providers)
  • Communications you send to us (emails, contact form submissions)

We also automatically collect certain technical information when you visit our website, including IP address, browser type, device information, pages visited, and referring URLs.

3. How We Use Your Information

We use the personal information we collect to:

  • Match families with a suitable tutor and facilitate an introduction — this is the primary purpose of collecting parent and student data
  • Communicate with you about our services
  • Verify tutor qualifications and credentials in our network
  • Process payments for tutor subscriptions and lead fees
  • Improve our website, services, and user experience
  • Comply with legal obligations

4. Sharing Your Information

We share personal information only in the following circumstances:

  • With tutors — when a family submits a request, we share relevant details (parent name, contact information, student subject and year level) with a suitable tutor as part of the service. The tutor is an independent third party, not an employee or agent of Top of the Class
  • With families — when we facilitate an introduction, we share the tutor's relevant professional details
  • With service providers — we use third-party tools for payment processing, email delivery, and analytics
  • As required by law — we may disclose information if required by a court order, subpoena, or other legal process

We do not sell, rent, or trade your personal information to third parties for marketing purposes.

5. Data Security

We take reasonable steps to protect your personal information from misuse, interference, loss, unauthorised access, modification, and disclosure. Our website uses SSL encryption, and we store data on secure, access-controlled servers.

6. Data Retention

We retain enquiry data for up to 24 months, after which it is securely deleted unless you have an active account. Tutor account data is retained for the duration of the account and for up to 24 months following account closure, unless a longer retention period is required by law.

7. Children's Data

Our platform may collect information about minors (students) provided by their parent or guardian through our enquiry form. This information — including the child's year level, subject, and suburb — is used solely for the purpose of matching the family with a suitable tutor. We do not knowingly collect personal information directly from children.

Parents or guardians may request deletion of their child's data at any time by contacting privacy@topoftheclass.com.au.

8. Your Rights — Access and Deletion

You have the right to access, correct, or delete the personal information we hold about you in accordance with the Australian Privacy Act 1988 (Cth). To make a request, contact us at privacy@topoftheclass.com.au. We will respond within 30 days.

If you believe we have breached the Australian Privacy Principles, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC).

9. Cookies and Tracking

Our website uses cookies and similar technologies to improve your browsing experience, analyse site traffic, and understand where our visitors come from. You can manage cookie preferences through your browser settings.

10. Changes to This Policy

We may update this Privacy Policy from time to time. The updated version will be posted on this page with a revised "Last updated" date. We encourage you to review this page periodically.
