Terms of Service

1. Acceptance of Terms
By accessing or using the Top of the Class website and services ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you should not use the Service. These terms apply to all users, including parents, students, tutors, and visitors.
2. Description of Service
Top of the Class is a tutor connection service. We facilitate introductions between families seeking private tutoring and qualified tutors in our network. We are not a tutoring agency, employment agency, or educational institution. Tutors are independent contractors, not employees or agents of Top of the Class.
3. For Parents and Students
Our service is free for parents and students. When you submit a tutor request, you agree to provide accurate information about your child's year level, subject needs, and location. We will use this information to find a suitable tutor and facilitate an introduction.
Top of the Class does not guarantee specific academic outcomes. We require tutors to submit proof of qualifications and a valid Working With Children Check, but the tutoring relationship is between you and the tutor. You are responsible for agreeing on rates, schedules, and lesson arrangements directly with the tutor.
4. For Tutors
By joining our network, you represent that all information provided in your application is accurate and complete. You agree to maintain current qualifications, a valid Working With Children Check (where applicable), and professional standards of conduct.
You acknowledge that you are an independent contractor. Top of the Class does not control how, when, or where you provide tutoring services. You set your own rates, schedules, and teaching methods.
Lead fees and subscription charges are billed according to the plan you select. All fees are in Australian dollars and inclusive of GST where applicable. You may change or cancel your plan at any time through your dashboard.
5. Lead Quality and Refunds
Top of the Class takes reasonable steps to ensure that family enquiries are genuine before they are distributed as leads. A lead is considered valid when the family has submitted a tutor request through our platform with accurate contact details, a nominated subject, year level, and suburb.
Lead fees are non-refundable except in the following circumstances:
- The contact details provided in the lead are demonstrably invalid (e.g. a non-working phone number and non-working email address); or
- The same lead has been sent to you more than once in error.
Refund requests must be submitted to support@topoftheclass.com.au within 7 days of receiving the lead, with a description of the issue. Top of the Class will assess requests at its sole discretion and may issue a lead credit (not a cash refund) where a claim is found to be valid.
Top of the Class does not guarantee that a family will book a session with you, respond to your outreach, or continue with tutoring. Lead fees reflect the cost of the introduction only.
6. User Conduct
You agree not to use the Service for any unlawful purpose, to provide false or misleading information, to harass or harm other users, or to interfere with the operation of the Service. We reserve the right to suspend or terminate accounts that violate these terms.
7. Intellectual Property
All content on the Top of the Class website — including text, graphics, logos, and software — is the property of Top of the Class or its licensors and is protected by Australian and international copyright laws. You may not reproduce, distribute, or create derivative works from our content without written permission.
8. Limitation of Liability
To the maximum extent permitted by law, Top of the Class shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability for any claim arising from these Terms shall not exceed the amount you have paid to us in the 12 months preceding the claim.
9. Disclaimer
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.
11. Changes to These Terms
We reserve the right to update these Terms at any time. The updated version will be posted on this page with a revised "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised terms.
